PART I. TERMS OF SERVICE & CUSTOMER AGREEMENT
1. Acceptance of These Terms
Welcome to Married Legally.
These Terms of Service, Disclaimers, and Customer Agreement (“Terms”) govern your use of Married Legally’s website, online marriage ceremony services, officiant services, marriage-license guidance, certificate assistance, relationship resources, immigration-related services where applicable, and other related offerings.
Married Legally is operated by Pemberton Law LLC DBA Married Legally (“Married Legally,” “we,” “our,” or “us”).
By accessing our website, submitting an inquiry, scheduling a consultation or ceremony, purchasing services, participating in a ceremony, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, you should not use our website or purchase or participate in our services.
Married Legally reserves the right to modify these Terms from time to time. Updated Terms will be posted on this website with a revised “Last Updated” date. Your continued use of the website or services after revised Terms become effective constitutes acknowledgment and acceptance of the revised Terms to the extent permitted by applicable law.
2. About Married Legally
Married Legally is a Utah-based private service provider operating as a DBA of Pemberton Law LLC.
Married Legally provides online marriage ceremony services, legally authorized officiant services, marriage-license guidance, marriage certificate assistance, relationship resources, educational resources, and other services described on our website.
Depending on the service requested, Married Legally may also coordinate services involving qualified legal professionals or other service providers.
Married Legally is not a government agency, court, county office, immigration agency, licensing authority, or government-operated website.
Information submitted to Married Legally does not constitute an application directly submitted to a government agency unless expressly stated otherwise.
Marriage licenses, marriage certificates, visas, immigration benefits, and other government decisions are issued or determined by the applicable government authority.
3. Description of Services

Services available to a customer may depend on the customer’s circumstances, eligibility, location, applicable laws, government requirements, scheduling availability, and the specific service purchased.
Married Legally reserves the right to modify, discontinue, or limit any service at any time.
4. Marriage License Requirements
Customers are responsible for obtaining their own marriage license through the appropriate government authority.
Married Legally does not:

Submit marriage-license applications on behalf of customers unless expressly agreed as part of a specific service;

Process or approve marriage-license applications;

Issue marriage licenses;
-
Determine whether customers satisfy all government eligibility requirements;

Guarantee that a marriage license will be issued.
Customers are responsible for ensuring that:

They provide accurate information to the applicable government authority;

Their identification documents are valid;
-
They meet all legal requirements applicable to their marriage;
-
They are not currently married to another person unless legally permitted;
-
They are entering the marriage voluntarily;
-
They complete all government-required steps;
-
They review documents and information for accuracy.
The couple must obtain any required government approval or marriage license before the ceremony when required by applicable law.
Married Legally relies upon the approval, verification, and determination processes completed by the applicable government authority.
5. Virtual Marriage Ceremonies
Where legally permitted and applicable to the customer’s circumstances, Married Legally may coordinate virtual marriage ceremonies using online video technology.
Virtual ceremony services may include:

Ceremony scheduling;

Virtual officiant participation;

Guest participation;
-
Ceremony coordination;
-
Personalized ceremony options;
-
Recording or other ceremony-related features when available.
The availability and requirements for a virtual ceremony may depend upon applicable laws, jurisdictional requirements, scheduling availability, technology, and the specific service package selected.
Customers are responsible for providing accurate information and complying with all requirements communicated to them before the ceremony.
Before participating in a ceremony, customers may be required to:

Verify their identity;

Provide required identification;

Confirm their voluntary participation;

Confirm that they meet applicable legal qualifications;

Complete other verification procedures reasonably required by Married Legally or the applicable government authority.
Married Legally officiants are legally authorized to solemnize marriages within the scope of their authority.
Married Legally may assign a substitute officiant or qualified third-party designee when reasonably necessary to complete a ceremony.
If an assigned officiant becomes unavailable, Married Legally may reschedule the ceremony at no additional cost. If a substitute officiant is required, Married Legally will cover any additional officiant expense associated with that substitution.
6. Witness Services
Some couples may request witnesses for their ceremony.
Where available, Married Legally may provide witnesses for an additional fee.
Witnesses may be independent contractors or third-party individuals assisting with the ceremony.
Customers acknowledge that witness participation does not guarantee acceptance, approval, or recognition of a marriage by any government agency or third party.
7. Marriage Certificates & Government Documentation
Where applicable, Married Legally may assist customers with obtaining or requesting marriage-related documentation.
Government-issued marriage certificates and other official records are controlled and issued by the applicable governmental authority.
Married Legally does not guarantee:

Issuance of a marriage certificate;

Acceptance of submitted documentation;
-
Processing times;
-
Availability of a particular certificate;
-
Timing of certificate delivery;
-
Acceptance of documentation by another government agency or third party.
Processing times may vary because of government processing, mailing services, documentation requirements, holidays, administrative delays, or other circumstances outside Married Legally’s control.
In Utah County, digital and physical certificates are processed and delivered by Utah County according to its procedures and timelines.
If a customer experiences delays, missing documents, mailing problems, or government-processing concerns, the customer should contact the applicable government office directly. Married Legally may assist customers in communicating with the applicable government authority when appropriate, but cannot guarantee resolution.
8. Apostille & Authentication Disclaimer
Married Legally does not guarantee apostille or authentication approval, acceptance, or processing times.
Where offered, Married Legally may provide general guidance or assistance concerning apostille or authentication processes.
Customers are responsible for ensuring that their documents satisfy the requirements of the receiving country, government agency, organization, or other recipient.
Government agencies or authorized entities retain authority over apostille and authentication decisions.
9. Immigration & Legal Services Disclaimer
Married Legally may provide or coordinate immigration-related consultations, document assistance, preparation support, interview preparation, or other immigration-related services where applicable.
Immigration laws and procedures are complex and may change over time.
Married Legally does not guarantee:

Visa approval;
-
Immigration approval;
-
Permanent residence;
-
Citizenship;
-
Work authorization;
-
Any other immigration benefit;
-
Any particular legal or administrative outcome.
Immigration decisions are made by applicable government authorities.
Where legal services are provided by a qualified attorney or law firm, those services may be governed by separate engagement agreements, privacy policies, professional obligations, and attorney-client relationships.
Submitting an inquiry through Married Legally does not automatically establish an attorney-client relationship with any attorney or law firm unless and until such a relationship is formally established according to the applicable legal professional’s procedures.
Customers seeking legal advice should consult a qualified attorney.
10. Payments
Payment is required in full at the time of purchase unless otherwise expressly stated in writing.
Payments may be processed through third-party payment processors, including Stripe.
Because Married Legally services may require immediate scheduling, preparation, coordination, reservation of resources, and allocation of officiant or other service-provider time, payments are generally non-refundable once submitted, except where a refund is expressly required by applicable law or specifically authorized by Married Legally.
11. Refund Policy
Except where otherwise required by applicable law, refunds are not provided for:

Change of plans;

Customer cancellation;

Failure to complete government requirements;
-
Government rejection or delay;
-
Immigration outcomes;
-
Customer-provided incorrect, incomplete, or misleading information;
-
Failure to appear for a scheduled ceremony;
-
Customer technology or internet problems;
-
Missed appointments;
-
Delays caused by third parties;
-
Failure to obtain required documentation;
-
Failure to satisfy applicable government requirements.
Nothing in this section is intended to waive any right to a refund or other remedy that cannot legally be waived.
12. Rescheduling Policy
Married Legally understands that circumstances may change. However, rescheduling requires additional preparation, scheduling, coordination, and allocation of resources.
A $40 rescheduling fee applies when:

A customer requests rescheduling within 30 days of the scheduled ceremony date;
-
A customer cancels and requests a new ceremony date;
-
A customer fails to appear for a scheduled ceremony;
-
A customer arrives more than 10 minutes late;
-
Customer technology, equipment, or internet problems prevent completion of the ceremony.
If Married Legally must reschedule because of officiant availability or technical problems caused by Married Legally, the rescheduling fee will not apply.
Married Legally may require additional fees when a customer requests services outside the scope of the original service purchased.
13. Technology Disclaimer
Online services and virtual ceremonies require reliable internet access and functioning devices.
Customers are responsible for having appropriate equipment, internet access, audio, video, and other technology necessary to participate.
Married Legally is not responsible for:

Customer internet outages;
-
Customer device failures;
-
Customer audio or video problems;
-
Customer software problems;
-
Third-party video-conferencing interruptions;
-
Third-party platform outages;
-
Cellular or internet-provider interruptions.
If technical problems prevent completion of a ceremony, Married Legally may reschedule the ceremony according to these Terms.
14. Photography, Video, Recording & Media Release
Married Legally may photograph, record, or capture screenshots during ceremonies and other services when appropriate.
By participating in a Married Legally ceremony, customers grant Married Legally permission to use photographs, videos, screenshots, testimonials, reviews, names, and wedding stories for marketing, educational, promotional, and informational purposes.
This permission may include use on:

Married Legally websites;
-
Social media platforms;
-
Advertising materials;
-
Promotional materials;
-
Educational materials;
-
Other Married Legally marketing channels.
Customers may opt out of marketing use by submitting a written request by email to Married Legally.
Opting out of marketing use does not affect Married Legally’s ability to provide services.
While Married Legally will make reasonable efforts to record ceremonies when recording is included or otherwise available, recording availability is not guaranteed.
Where ceremony recordings are provided, recordings are expected to become available within approximately seven days after the ceremony, unless otherwise communicated.
15. Customer Responsibilities
Customers agree to:

Provide accurate, complete, and current information;

Provide truthful documentation;

Promptly notify Married Legally if previously provided information changes or is inaccurate;

Follow applicable government requirements;
-
Review information submitted on their behalf where applicable;
-
Provide required documents accurately and on time;
-
Attend scheduled consultations and ceremonies;
-
Follow instructions provided for the selected service;
-
Participate respectfully;
-
Maintain appropriate behavior during interactions;
-
Maintain the confidentiality of account, appointment, and access information;
-
Ensure that information submitted on behalf of another person is provided with appropriate authorization.
Customers are responsible for consequences resulting from inaccurate, incomplete, outdated, misleading, or fraudulent information supplied by them.
16. Right to Refuse or Discontinue Service
Married Legally reserves the right to refuse, suspend, reschedule, or discontinue services when there is reasonable concern regarding:

Fraud;

Misrepresentation;
-
Intoxication;
-
Unsafe behavior;
-
Harassment;
-
Abuse;
-
Coercion;
-
Suspected illegal activity;
-
Impersonation;
-
Unauthorized use of another person’s information;

A marriage that may not be entered into voluntarily;

Conduct that threatens the safety of customers, employees, contractors, officiants, witnesses, or other participants;

Material violation of these Terms.
Married Legally is not responsible for consequences resulting from false information, misrepresentation, misconduct, or other prohibited conduct by customers.
17. Independent Contractors
Married Legally may utilize independent contractors, including officiants, witnesses, photographers, technology providers, translators, consultants, and other service providers.
Independent contractors may perform assigned responsibilities while maintaining their independent status.
Married Legally may use third-party providers when reasonably necessary to deliver or support requested services.
18. Third-Party Services & External Platforms
Certain services may require the use of third-party platforms, including:

Video-conferencing services;
-
Payment processors;
-
Scheduling systems;
-
Communication platforms;
-
SMS providers;
-
Government websites;
-
Document-processing services;
-
Translation providers;
-
Other external services.
Third-party services operate under their own terms, privacy policies, and conditions.
Married Legally is not responsible for the availability, security, functionality, content, privacy practices, or policies of third-party platforms that Married Legally does not control.
19. Chargebacks & Payment Disputes
Before initiating a payment dispute, chargeback, or complaint with a financial institution, customers agree to first contact Married Legally and provide a reasonable opportunity to investigate and resolve the concern.
Married Legally is committed to addressing legitimate customer concerns fairly and efficiently.
Nothing in this provision prevents a customer from exercising any rights that cannot legally be waived.
20. Mediation & Arbitration
These Terms are governed by the laws of the State of Utah, to the extent applicable.
In the event of a dispute, the customer and Married Legally agree to first attempt to resolve the dispute through good-faith communication.
If the dispute cannot be resolved through good-faith communication, the parties agree to participate in mediation before pursuing further legal action, to the extent permitted by applicable law.
If mediation does not resolve the dispute, the parties may proceed to binding arbitration as permitted under applicable law.
Nothing in this section is intended to waive rights or remedies that cannot legally be waived.
21. Intellectual Property
All content on the Married Legally website, including:

Graphics;
-
Images;
-
Videos;
-
Service descriptions;
-
Website design;
-
Branding;
-
Software;
-
Written materials;

Educational materials;
is owned by Pemberton Law LLC DBA Married Legally, its licensors, or applicable content providers and is protected by applicable intellectual-property laws.
Except as permitted by applicable law, customers may not copy, reproduce, distribute, modify, publish, transmit, sell, or exploit website content without prior written permission.
22. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website and services are provided on an “as is” and “as available” basis.
Married Legally does not guarantee that:

-
The website will be error-free;
-
Services will always be available at a particular time;
-
Government processing will occur within a particular timeframe;

A government agency will approve an application or document;

Government agencies, courts, licensing authorities, immigration authorities, postal services, and other third parties operate independently of Married Legally.
23. Limitation of Liability
To the fullest extent permitted by applicable law, Married Legally shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of, or inability to use, the website or services.
This includes losses resulting from:

Third-party platform failures;

Government processing delays;
-
Government decisions;
-
Immigration decisions;
-
Delayed documentation;

Incorrect information supplied by a customer;

Missed appointments;

To the fullest extent permitted by law, the maximum aggregate liability of Married Legally arising from a customer’s purchase or use of Married Legally services shall not exceed the amount actually paid by that customer for the specific Married Legally service giving rise to the claim.
Married Legally is not responsible for decisions, delays, errors, or actions taken by government agencies, courts, immigration authorities, postal services, third-party vendors, or other external organizations.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

By purchasing services through Married Legally, submitting an electronic form, checking an acknowledgment box, opting into SMS communications, scheduling a service, or otherwise electronically accepting these Terms, customers agree that such electronic acceptance constitutes a legally binding agreement to the fullest extent permitted by applicable law.

Submitting information through the Married Legally website does not itself guarantee approval of any marriage, immigration application, visa, or government proceeding.
39. Payment Information
If you purchase a service through our website or another authorized payment channel, payment information may be processed by third-party payment processors.
We may receive limited transaction information, such as:
